These Terms of Use (the “Terms”) are a binding agreement between you (“Customer”, “you”) and Paullex, Inc (“Company”, “we”, “us”, or “our”). These Terms govern your access to and use of the ReviewX platform, including the web application at https://app.reviewx.ai and SMS link domain at https://sms.reviewx.ai, together with any related websites, APIs, and services (collectively, the “Service”).
ReviewX is a business messaging and customer feedback platform that enables businesses to send review requests, feedback requests, and related service communications to their own customers.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
The Service is intended for business use by companies, organizations, and their authorized representatives. If you use the Service on behalf of a business or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms.
You may use the Service solely for your internal business purposes and only to communicate with your own customers, users, leads, or contacts in compliance with applicable law.
You agree to provide accurate, current, and complete information when creating and maintaining your account. You are responsible for your account credentials and all activity conducted through your account.
You are solely responsible for your relationship with your end users and customers, including the collection, accuracy, and lawful use of customer contact information uploaded to or processed through ReviewX.
You are solely responsible for obtaining all legally required consent before sending any SMS or other messages through the Service to your customers or end users. Consent must be obtained directly by you or on your behalf and must clearly disclose that the recipient agrees to receive messages from your business, which may be sent using ReviewX as your messaging platform.
You must maintain records of consent, including when and how consent was obtained, and you must provide such records upon request if needed for compliance review, carrier review, or dispute resolution.
You must not use purchased, rented, shared, scraped, appended, or third-party contact lists. You must not send messages to recipients who have not provided the required consent.
ReviewX enables you to send review requests, feedback requests, reminders, and related customer service communications to your own customers. Messages may contain links hosted on app.reviewx.ai or shortened links on sms.reviewx.ai.
You are responsible for ensuring that your messages include any disclosures required by law, carriers, or industry guidelines, including brand identification, opt-out instructions, and any applicable message frequency or rate disclosures.
You may not use the Service to:
The Service may rely on third-party providers, including messaging carriers, aggregators, hosting providers, analytics providers, and other service providers. We are not responsible for the acts, omissions, filtering, delays, or service limitations of third parties, but we may work with such providers to support Service operations.
Our collection and use of personal data through the Service is described in our Privacy Policy, available at https://app.reviewx.ai/privacy. By using the Service, you agree to that Privacy Policy.
You are responsible for providing any notices and obtaining any consents required for your use of the Service and your collection and submission of personal data.
Paullex, Inc owns all rights, title, and interest in and to the Service, including all software, technology, designs, text, graphics, and related intellectual property, except for your data and materials.
You retain rights in your own data, business content, and customer information. You grant us a limited, non-exclusive license to host, use, process, and transmit your data solely as necessary to provide, maintain, support, secure, and improve the Service and comply with applicable law.
We may suspend, limit, or terminate access to the Service immediately if we reasonably believe that you have violated these Terms, applicable law, carrier requirements, or messaging compliance requirements, or if your use of the Service may cause harm to us, the Service, carriers, or third parties.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee message delivery, message timing, carrier acceptance, click-through results, review outcomes, or uninterrupted availability of the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAULLEX, INC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
You agree to indemnify, defend, and hold harmless Paullex, Inc and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your messaging practices, your failure to obtain proper consent, your content, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Washington State.
We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, by email, or by other reasonable means. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the updated Terms.
